Na,die Verjährung von Ansprüchen, sind mit der Klageerhebung unterbrochen . Alle die schon geklagt haben,brauchen sich natürlich um Verjährung keine Sorgen mehr machen. Je länger es dauert, je mehr Zins und Zinses Zins. Und du hast absolut recht, die Grossen,ganz Grossen,können es sich garnicht erlauben Pleite zu gehen,da die Aktionäre,denen die Bude einrennen würden . Bei den kleinen ist es sehr gut möglich,das Sie es alleine schon wirtschaftlich nicht überleben würden und daher vorher insolvent gehen,wenn die Ansprüche, denen der Eigenmittel übersteigen würde,denke Ich.

Things are going well for the providers at the moment, as they are gaining time and there are many impatient/uncertain (potential) plaintiffs. I don't exclude myself from this either, I have been involved since 2022 and would also like to see an end. 😁

Klar gibt es Zinsen, viele werden aber dennoch Vergleiche annehmen wenn die Verfahren wieder aufgenommen werden (nachhaltiger Effekt). Ebenso ist durch die Aussetzung vieler Verfahren der Strom von Geldern, die zurück an die PKFs fließen gestoppt. Ergo: neue Klagen werden gestoppt, ebenso Verunsicherung bei einigen die geplant haben selbstfinanziert klagen. Für die Anbieter läuft es gerade gut, da sie Zeit gewinnen und es viele ungeduldige/verunsicherte (potentielle) Kläger gibt. Schließe mich da auch nicht aus, bin seit 2022 dabei und würde auch gerne mal ein Ende finden. 😁

Unfortunately, I don't know exactly how things work in Austria, and I've only recently read through the topic here, which is mainly about Pokerstars (in my case, it's about other, sometimes large, providers) where there are already proceedings in the Maltese court(?).

I have judgments myself, some suspended proceedings and a few that are currently ongoing. However, a settlement offer would be possible on any point. For some of the judgments that I have (none in execution yet, since Bill 55 came into effect), I would still accept a settlement. Simply because the provider has since restructured and in the worst case scenario I won't see any money at all. For other ongoing proceedings (e.g. Bwin, Tipico, ...) I will wait and see, as I think a total loss is unlikely here for exactly the reasons that other users have mentioned.

Ich weiß leider nicht wie es genau in Österreich läuft, auch habe ich mich erst kürzlich durch das Thema hier in gelesen wo es es hauptsächlich um Pokerstars geht (bei mir geht es um andere, teilweise große , Anbieter) wo es schon Vorgänge beim maltesischen Gericht gibt(?).

Ich habe selbst Urteile, einige ausgesetzte Verfahren und ein paar die aktuell weitergehen. Ein Vergleichsangebot wäre aber zu jedem Punkt möglich. Bei einigen Urteilen die ich habe (noch keines in der Exekution, da Bill 55 kam) würde ich aktuell z.B. trotzdem einen Vergleich annehmen. Einfach aus dem Grund, dass der Anbieter mittlerweile umstrukturiert hat und ich im schlechtesten Fall gar kein Geld sehe. Bei anderen laufenden Verfahren (z.B. Bwin, Tipico, ...) werde ich die Zeit abwarten, da ich hier einen Totalausfall für unwahrscheinlich halte aus genau den Gründen, die andere User genannt haben.

Damals big Player wo sie wussten die haben viel Geld sind auch insolvenz angemeldet.

Es kommt drauf an ob sie das Geld in der Zeit wo wir warten das Geld verschwinden lassen ins Ausland das es nicht mehr greifbar ist.

Die meinten auch das es noch 6 Monate oder 2 Jahre dauern kann.

Fazit: Die prozessfinanzierer sind sehr optimistisch aber es kann alles passieren.

In Austria too, PKFs are disappearing and then all opportunities are gone... including our chance of getting the money.... Someone has a new company in Slovakia, is it still going well??? It's not just the OCs that are letting us down. Only the lawyers have won, they already have their money.

OCs are going bankrupt and closing down one after the other, so we can forget about all the judgements... many are no longer accessible online in Austria. So yes, a lot is happening...

Auch in Österreich verschwinden PKFs und dann ist alles an Chancen weg… auch unsere Chance auf das Geld…. Einer hat eine neue Firma in der Slowakei, ob das noch richtig gut läuft??? Nicht nur die OCs lassen uns hängen. Nur die Anwälte haben gewonnen, die haben ihr Geld schon.

OCs gegen sich der Reihe nach insolvent und sperren zu, da können wir uns auch alle Urteile schenken… viele sind in AT nicht mehr online erreichbar. Also ja es tut sich viel….

In our opinion and that of many lawyers, this law contradicts European law. The European Court of Justice (ECJ) is currently examining the Bill 55 law in Malta and will then make a ruling on whether it should remain in place or should be overturned. We believe that Bill 55 should be repealed and that casino operators can then be forced to pay back their losses.

As to the big question of WHEN the ECJ will decide, we can only say that we do not know. It cannot be ruled out that this could drag on for several years. Therefore, we can only advise you to remain patient, as this affects thousands of plaintiffs and everyone has to wait.

If the judgment is final, the enforcement fee is payable and the execution is executed, your claims do not expire. If the judgment is suspended, the statute of limitations is at least suspended.

Nein bei mir hat er sich echt viel Zeit genommen und alles ausführlich erklärt.

Er meinte die warten auf die Entscheidung vom eugh und die eu kommission prüft es schon seit 18 monate.

Und selbst wenn eine Entscheidung vom eugh und eu kommission kommt wissen sie nicht mal ob malte trotz Urteil sich weiterhin weigern wird und das Urteil zurückziehen wird.

Wir sind der Ansicht, dass Bill 55 aufgehoben wird und man anschließend die Casinoanbieter dazu bringen kann, Ihre Verluste zurückzubezahlen.

Auf die große Frage, WANN der EuGH dies entscheidet, können wir nur sagen, dass wir es nicht wissen. Es ist nicht auszuschließen, dass sich dies noch über mehrere Jahre ziehen kann. Demnach können wir nur dazu raten, Geduld zu bewahren, da dies tausende Kläger betrifft und alle abwarten müssen. 

Bei Rechtskräftig, Exekutionsgebühr und Exekution verjähren Ihre Ansprüche nicht. Bei Ausgesetzt ist zumindest die Verjährung gehemmt.

It seems to me that they have only been pretending for a while and hoping that the ECJ would finally get involved.

Das finde ich super, das ist wenigstens ehrlich. Jedes mal sagt mein Anwalt nur, ja der hat jz 18 Monate Zeit und bla. Bla und dann sind 3 Jahre um und nichts , weil nicht mal die Verfahren liefen.

Mir kommt vor, als hätten die eine Zeit lang nur so getan und gehofft, dass endlich der EuGH eingeschalten wird.

Just look at the comments on YouTube, they don't even want to address that.

E.g. casino papers, Malta rulings in February, PKF going bankrupt, EU court hearing, tax office taking taxes from the casinos, nothing is discussed, only the positive things are brought up, yes we are now at the EU court, yes Malta has finally issued a ruling, we are suing in other EU countries, they are not allowed to tell you, they want to surprise the casinos.
