Olá pessoal,

Estou entrando em contato para pedir conselhos ou apoio em relação à minha tentativa contínua de obter um reembolso da Stake.

Sou francês e criei minha conta usando meu documento de identidade e meu endereço IP reais. Tenho até capturas de tela das minhas sessões como prova.

Meu depósito total foi de 2,32 BTC. Espero recuperar pelo menos 40.000 EUR/USD.

Tentei primeiro com um advogado francês, que apenas enviou uma carta para a Austrália. Infelizmente, nunca recebemos nenhuma resposta.

Depois, contratei Roelof, mas após me fazer esperar um ano inteiro, ele finalmente me disse para procurar outro advogado. Ele explicou que é muito difícil ter sucesso em Curaçao porque há muitos casos.

Outro advogado francês me pediu 6.000 euros adiantados, sem garantir nada e sem sequer explicar quais medidas tomaria.

Neste momento, estou desesperado. Alguém pode me dizer o que posso fazer ou qual órgão/autoridade jurídica devo contatar? Alguém aqui já conseguiu obter um reembolso da Stake ou conhece algum advogado ou estratégia jurídica que possa funcionar nesta situação?

Qualquer orientação ou recomendação será muito apreciada. Agradeço antecipadamente pela sua ajuda.

BREAKING NEWS: MANAGING DIRECTOR LIABILITY:‼️🔝

In Austria, the first Supreme Court ruling following the WUNNER case (ECJ C-77/24), which I brought before the European Court of Justice, has just been issued! The Supreme Court follows the ECJ and, in a lawsuit concerning the personal liability of the management of an illegal online casino for offering gambling without a license in Austria, has reached the following clear conclusion:

✅ Austrian substantive law applies pursuant to Article 4(1) of the Rome II Regulation.

✅ The international jurisdiction of Austrian courts is established pursuant to Article 7 No. 2 of the Brussels I Regulation (Regulation (EC) No 44/2012).

The Supreme Court has already made a substantive statement (❗) in this decision:

"According to existing case law under Austrian law, external liability of a company's organ can, in principle, exist for the culpable violation of a protective law pursuant to Section 1311 of the Austrian Civil Code (ABGB), whereby player protection provisions of the Austrian Gambling Act (GSpG) have already been classified as protective laws." (9 Ob 8/26f)

Lawsuits seeking personal liability from the management of an illegal online casino have now received their first confirmation from the highest court – liability is possible. In Austria. Under Austrian law.

BREAKING NEWS GESCHÄFTSFÜHRERHAFTUNG:‼️🔝 

In Österreich ist soeben das erste OGH Urteil nach dem von mir vor dem Europäischen Gerichtshof geführten Fall WUNNER (EuGH C-77/24) ergangen! Der OGH folgt dem EuGH und kommt bei einer Klage auf persönliche Haftung der Geschäftsführung eines illegalen Online-Casinos wegen lizenzlosem Glücksspielangebot in Österreich zu folgendem klaren Ergebnis:

✅ Österreichisches Sachrecht kommt gemäß Art 4 Abs 1 Rom II-VO zur Anwendung

✅ Die internationale Zuständigkeit österreichischer Gerichte ist nach Art 7 Nr 2 EuGVVO 2012 gegeben

Der OGH hat sich in dieser Entscheidung auch bereits inhaltlich (❗) geäußert: 

"Nach zum österreichischen Recht schon vorliegender Rechtsprechung kann eine Außenhaftung eines Organs einer Gesellschaft bei schuldhafter Verletzung eines Schutzgesetzes nach § 1311 ABGB grundsätzlich bestehen, wobei Spielerschutzvorschriften des GSpG bereits als Schutzgesetze qualifiziert wurden." (9 Ob 8/26f)

Die Klagen auf persönliche Haftung der Geschäftsführung eines illegalen Online-Casinos haben nunmehr die erste höchstgerichtliche Bestätigung erhalten - eine Haftung ist möglich. In Österreich. Nach österreichischem Recht.
