Dein Anwalt hat null Ahnung, keiner weiß was der eugh entscheiden wird.

Natürlich kann der eugh für österreich oder für malta entscheiden aber das hindert nicht an den Rückerstattung.

Die bill no 55 ist eu rechtswidrig und das wird es auch bleiben und europäische urteile werden anerkannt laut zahlreiche Experten und anwälte sogar ein ex eu Richter hat das bestätigt also bitte macht den leuten hier keine angst danke 🙂

Munich, May 21, 2024. Without the required license, online gambling is prohibited in Germany and Austria. This has not stopped many gambling providers, including those from Malta, from offering their illegal games of chance here as well. Players have the opportunity to reclaim their losses from prohibited games of chance. Numerous courts have already confirmed this right to repayment. The Maltese government is now standing up for the gambling providers and, with Bill No. 55, aims to prevent these rulings from being enforced in favor of players in Malta. "However, this Maltese regulation is unlikely to be compatible with EU law," says attorney István Cocron of CLLB Rechtsanwälte.

Background: In Germany, online gambling was generally prohibited until July 1, 2021. Since then, it has only been permitted if the provider has a license valid in Germany. A large portion of online gambling is also prohibited in Austria. As a result, players can reclaim their losses from prohibited online gambling. "Numerous courts in Germany and Austria have already confirmed this right of repayment by players," says attorney Cocron, who has successfully represented numerous players.

Now the Maltese government is taking a protective stance against gambling companies based in Malta. It passed Bill No. 55 in June 2023. The law prohibits Maltese courts from recognizing or enforcing judgments from other EU member states, such as Germany or Austria, if they are directed against Maltese gambling operators.

"The gambling industry in Malta obviously enjoys a large lobby. Otherwise, this action by the Maltese government cannot be explained. While Bill No. 55 is a setback for many players who have lost money playing online games with Maltese providers, it is unlikely to be legally sustainable," reassures attorney Cocron.

According to the principles of the European Union, judgments from other EU member states must generally be accepted and enforced. "Bill No. 55 therefore violates EU law," says attorney Cocron. The EU Commission has already taken action and is reviewing the "Gaming Act, Cap. 583" for its compatibility with European law. However, it may still take some time before a decision is made.

München, 21.05.2024. Ohne die erforderliche Lizenz sind Online-Glücksspiele in Deutschland und Österreich verboten. Das hat viele Glücksspielanbieter, u.a. aus Malta, nicht davon abgehalten, ihre illegalen Glücksspiele auch hierzulande anzubieten. Spieler haben die Möglichkeit, sich ihre Verluste aus verbotenen Glücksspielen zurückzuholen. Zahlreiche Gerichte haben diesen Rückzahlungsanspruch bereits bestätigt. Maltas Regierung stellt sich nun vor die Glücksspielanbieter und will mit der Bill No. 55 verhindern, dass diese Urteile zu Gunsten der Spieler in Malta durchgesetzt werden können. „Diese maltesische Regelung dürfte sich allerdings nicht mit EU-Recht vereinbaren lassen", sagt Rechtsanwalt István Cocron, CLLB Rechtsanwälte.

Zum Hintergrund: In Deutschland waren Online-Glücksspiele bis zum 1. Juli 2021 grundsätzlich verboten. Seitdem sind sie nur dann zulässig, wenn der Anbieter über eine in Deutschland gültige Lizenz verfügt. In Österreich ist ebenfalls ein großer Teil der Glücksspiele im Internet verboten. Folge ist, dass die Spieler ihre Verluste aus verbotenen Online-Glücksspielen zurückfordern können. „Diesen Rückzahlungsanspruch der Spieler haben schon zahlreiche Gerichte in Deutschland und Österreich bestätigt", so Rechtsanwalt Cocron, der bereits zahlreiche Spieler erfolgreich vertreten hat.

Nun stellt sich die maltesische Regierung schützend vor die Glücksspielunternehmen mit Sitz in Malta. Sie verabschiedete im Juni 2023 die Bill No. 55. Das Gesetz verbietet es maltesischen Gerichten, Urteile anderer EU-Mitgliedsstaaten wie Deutschland oder Österreich anzuerkennen oder zu vollstrecken, wenn sie sich gegen maltesische Glücksspielanbieter richten.

„Offensichtlich genießt die Glücksspielindustrie in Malta eine große Lobby. Ansonsten ist dieses Vorgehen der maltesischen Regierung nicht zu erklären. Die Bill No. 55 ist zwar ein Dämpfer für viele Spieler, die bei Online-Glücksspielen von maltesischen Anbietern Geld verloren haben, rechtlich dürfte sie aber kaum zu halten sein", beruhigt Rechtsanwalt Cocron.

Denn nach den Grundsätzen der Europäischen Union müssen Urteile aus anderen EU-Mitgliedsstaaten grundsätzlich angenommen und vollstreckt werden. „Die Bill No. 55 verstößt demnach gegen EU-Recht", so Rechtsanwalt Cocron. Die EU-Kommission ist bereits aktiv geworden und prüft den „Gaming Act, Cap. 583" auf seine Vereinbarkeit mit europäischen Recht. Bis zu einer Entscheidung kann aber noch Zeit vergehen.

Bill 55 will therefore be handled in a separate procedure. The only thing that can (and will) happen after April 9th is that there will be an increase in settlement offers from the casinos. I think it will be another one or two years before Bill 55 is deemed non-compliant with EU law. At the very least, the courts will continue with the repayment claims if the ECJ rules after April 9th that the repayment claims are legal, but even after the promised enforcement order, they cannot be enforced in Malta for the time being.

If the decision goes in favor of the players, the ball will finally start rolling. 💪🏻

Bill 55 wird demnach in einem gesonderten verfahren behandelt. Das einzige was nach dem 09.04. passieren kann (wird), dass es vermehrt Vergleichsangebote seitens der Casinos geben wird. Ich denke, bis Bill 55 als nicht EU konform eingestuft wird, vergehen nochmal 1-2 Jahre. Zumindest geht es gerichtlich mit den Rückforderungen weiter, sollte der EuGH nach dem 09.04 entscheiden, dass die Rückforderungen rechtens sind, aber nach zugesagten Vollstreckungstitel trotzdem erstmal nicht in Malta vollstreckt werden kann.

Sofern zugunsten für die Spieler entschieden wird, kommt dennoch endlich der Stein langsam rollen. 💪🏻
