They can assume whatever they want... if the EU Commission, and in case of doubt the ECJ, declare Bill 55 to be contrary to European law, Malta MUST make a change, as state liability could arise under certain circumstances. And before that happens, they'd rather hand over the casinos to the kingpin.

I know so many people who have a judgment but don't even have a legal order for execution. Theoretically, none of them could see any money. Besides, we don't even know if the casinos that have so far will pay and settle.

Ja aber wenn das zum EuGH geht, vergehen nochmal Jahre . Das ist wirklich eine Schande, wenn man bedenkt seit wann diese Gesetze beschlossen wurden. Und dann werden noch so viele in Konkurs gehen und dann bekommen eh nur die das Geld , bei denen es hinterlegt ist auf Malta bzw. Die einer der ersten waren bei den Klagen .

Ich kenne so viele , die ein Urteil haben aber noch nicht mal einen Titel zur Exekution. Die könnten alle dann kein Geld sehen theoretisch. Abgesehen davon , wissen wir nicht mal mehr ,ob dann die Casinos bezahlen und vergleichen, die es bis jetzt noch getan haben.

Und da der Druck langsam stärker wird, wird die Kommission sicher nicht endlos mit Maßnahmen warten.

If the ECJ rules that Bill 55 is unlawful (which is where things are headed), Malta must comply with all judgments, not just the enforcement orders. All countries can then invoke the new situation, and Malta will be forced to pay because if it doesn't comply, the EU can impose sanctions on Malta or impose a fine that is definitely higher than the plaintiffs would have to pay.

So let's wait and see how Malta will react to this before everything is painted black again.....

Malta muss dann Einlenken und ALLEN ausländischen Urteilen nachkommen. Genau das ist ja dann der springende Punkt. Wenn der EuGH beschließt das Bill 55 rechtswidrig ist (in diese Richtung geht das ja gerade), muss Malta allen Urteilen nachgehen und nicht nur den Exekutionstiteln. Alle Länder können sich dann auf die neue Situation berufen und Malta ist gezwungen zu zahlen weil wenn sie sich nicht daran halten kann die EU Sanktionen gegen Malta verhängen bzw. eine Geldstrafe verhängen die definitiv höher ist als den Klägern zahlen müssten.

Also warten wir Mal an wie Malta darauf reagieren wird, bevor gleich wieder alles schwarz gemalt wird.....

weiß jemand, ob die Gegenseite dann dort die Kosten übernimmt weil es steht bei manchen Urteilen dabei, die Kosten werden bis auf weiteres geteilt .?

Wenn die Casinos klug sind, zahlen die direkt und lassen nicht noch tausende Urteile bis zur Exekution kommen.

Sollte ,wie erwartet, das ganze Kartenhaus in sich zusammen fallen müssen die Casinos deutlich sparender sein mit Gerichtskosten, Zinsen etc.
